Public Defender uses position and taxpayers resources to intimidate ex-wife in custody battle!

Veterans In Politics International has been observing and investigating the family court, case Gutierrez vs. Gutierrez. Like many court cases in family court, the rule of evidence is out the window, the facts are manipulated, and favoritism amongst attorneys falls into play.

In this situation the mother is a religious Mormon follower, she works, she takes care of her children, she already raised an adult child, she has no record of criminal activities, no record of abuse or neglect, no CPS involvement, she does not drink alcoholic beverages, she does not use drugs or tobacco products, and she does not even have a traffic ticket.

So why would someone like this have an issue with the Clark County Family Court System? Two reasons: 1: She cannot compete with the father’s government job. 2. The fact that he is an attorney in the Clark County Public Defender’s Office! Hummmmm?

The father Seth Gutierrez is extremely controlling and intimidating, the mother is barely 100lbs soaking wet and the father is at least 230lbs, in addition, he is at least a foot taller. Our organization has witnessed the way he talks to her and it is disgusting and demeaning.

Seth Gutierrez is getting everything he wants out of Clark County Family Court Judge Cheryl Moss and in addition, Seth Gutierrez is trying to have the mother tossed in jail for several contempt charges.

In the last hearing on 12/02/19 before Judge Moss, the mother Cassandra Gutierrez requested a Public Defender to help her with the contempt issues, ironic isn’t it? Cassandra Gutierrez argued that if the court is attempting to take away her freedom, she is entitled to an attorney. Judge Moss replied that this is a civil trial not criminal so the court is not required to assign her a lawyer.

That’s funny we did not know a jail cell could tell the difference between civil contempt and a criminal trial. Not only should Cassandra Gutierrez be afforded an attorney, because she is more than qualified for one, she should also have a jury trial. It is clear to many that Judge Moss is biased and even more so because Moss is retiring and her name will not be on the ballot in January 2020.

In this same trial, Seth Gutierrez requested a “closed hearing”, why? To isolate and discredit the mother, without a thought Judge Moss kicked out the lone court observer (see video here: A Clark County Public Defender Seth Gutierrez requested a CLOSED HEARING! This custody battle like many has been going on for over 5 years. Why? Because the courts and attorney’s drag these cases out to help increase their caseload for more judges and milk litigants for their financial worth.

In addition, the father Seth Gutierrez uses his position with the Clark County Public Defender’s Office to intimidate third party agencies that are affiliated with his children school or their counseling, he uses his taxpayers email addresses that are assigned to him by the Public defender’s office Seth.Gutierrer@clarkcountynv.gov and at the bottom of every email, he has his title and office location.

The Veterans In Politics International submitted a Freedom of Information Request we requested email’s that he used from taxpayer’s computers for personal use and we were sent 70 different emails that were used from the taxpayer’s computers the hours ranging from 8 am to 9 pm. To add insult to injury below are some of the videos of Seth Gutierrez’s personal custody court appearances in family court all of them are during normal working hours.

Did this Public Defender take time off from his taxpayer’s job to appear on his personal custody case or is he shortchanging the public that he took an oath to defend, by making them take unnecessary plea deals or failing to represent them at the best of his ability in court?

We placed a call into the Clark County Managers office who oversees the Public Defender’s office, but have not received a return call, go figure?
